What is a Simple Divorce?

A Simple Divorce — sometimes called an Uncontested Divorce — is a legal process where one spouse files for divorce, asking only for the dissolution of the marriage.
It does not involve claims related to child custody, support, or division of property as part of the divorce application itself (those matters are either already settled or are dealt with separately).

Simple Divorce is suitable when:

Requirements for a Simple Divorce in Ontario (or adapt to your province):

Marriage Certificate

A government-issued marriage certificate (or an acceptable alternative if not available).

Separation

You must have been living separate and apart for at least one year, or qualify under other grounds such as adultery or cruelty.

Residency

Either spouse must have lived in Ontario for at least 12 months immediately before applying.

Agreement on Divorce

Both parties must agree to the divorce or at least not oppose it.

Steps Involved in a Simple Divorce

Gather Required Documents

Including your marriage certificate and basic personal information

Prepare and File the Divorce Application

Serve the Application (if required)

Submit Affidavit for Divorce
